3. User Obligations and Responsibilities

You agree to provide accurate, current, and complete information about your puppy and to promptly update us regarding any changes.

You represent and warrant that your puppy:

  • Is in good health and free from contagious illness, parasites, or other conditions that may endanger other animals or persons;
  • Has received all required and age-appropriate vaccinations, unless otherwise agreed by us in writing and permitted by applicable law;
  • Is fit for participation in group care, socialization, and play activities;
  • Does not have a history of aggression, biting, or other dangerous behaviour that has not been disclosed to us;

You agree to disclose in advance any special needs, behavioural concerns, allergies, dietary restrictions, medication instructions, anxieties, escape risks, or medical conditions relevant to your puppy’s care.

You are responsible for ensuring that any items you provide, including food, medication, bedding, collars, harnesses, toys, or other belongings, are safe and suitable. We are not responsible for loss, damage, or destruction of personal items unless caused by our gross negligence or wilful misconduct to the extent such liability cannot be excluded under applicable law.

You authorize us to act in good faith and use reasonable discretion in caring for your puppy, including separating puppies, modifying activities, providing rest periods, or contacting you if concerns arise.

You agree to pick up your puppy on time. Late pick-up may result in additional charges, scheduling disruption, or refusal of future bookings.

4. Payment Terms and Conditions

Fees for services will be communicated at the time of booking, by published rate sheet, invoice, or written agreement. All fees are stated in Canadian dollars unless otherwise specified.

Unless otherwise agreed in writing:

  • Payment is due in advance of service or upon invoice issuance, as applicable;
  • We may require deposits or pre-authorized payment methods to secure bookings;
  • Applicable taxes, including GST/HST and any other required taxes, will be added where required by law;
  • Returned payments, chargebacks, or failed transactions may incur administrative fees and may result in suspension of services;
  • Past due accounts may bear interest at the maximum rate permitted by law, if disclosed and permitted under applicable law.

We reserve the right to adjust pricing, fees, and billing practices at any time. Changes will apply prospectively and, where reasonable, will be communicated in advance.

Any promotional offers, packages, credits, or membership benefits are subject to stated conditions and may be modified or withdrawn at our discretion, subject to applicable law and any existing contractual commitments.

5. Cancellation and Refund Policy

Cancellations and rescheduling are subject to our booking policy in effect at the time of reservation. If no separate policy applies, the following general terms apply:

  • Booking cancellations should be made as early as possible;
  • Deposits may be non-refundable unless otherwise required by law or expressly stated otherwise in writing;
  • Short-notice cancellations, no-shows, or late arrivals may be charged in full or partially charged at our discretion, to the extent permitted by law;
  • Refunds, if any, will be issued only where required by law or expressly approved by us in writing.

If your puppy is unable to attend due to illness or other circumstances, you must notify us promptly. We may, at our discretion, offer a rescheduled session or credit, but are under no obligation to do so unless required by law or a written agreement.

We may cancel or pause services if we determine that your puppy poses a health, safety, or behavioural risk, if required vaccination or disclosure information is missing, or for other reasonable cause. In such cases, refunds will be handled in accordance with applicable law and our booking terms.

6. Liability Limitations

To the fullest extent permitted by applicable law, Northern Paws Care Ltd., its directors, officers, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of use, loss of goodwill, or loss of data, arising out of or related to your use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount paid by you for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to liability, or the minimum amount permitted by law if a lower limitation would be unenforceable.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, fraud, or any other liability that cannot lawfully be limited under Canadian law.

You acknowledge that participation in puppy daycare and socialization involves inherent risks, including but not limited to minor injuries, stress, illness transmission, behavioural incidents, and damage to personal property. You assume these risks to the extent permitted by law and agree that your puppy participates at your own risk, subject to the standards and obligations set out in these Terms.

You agree to indemnify, defend, and hold harmless Northern Paws Care Ltd. from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your puppy’s behaviour, your failure to disclose material information, or your violation of any law or third-party rights, except to the extent caused by our gross negligence or wilful misconduct and to the extent such indemnity is enforceable under applicable law.

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, power outage, internet or telecommunications failure, labour disruptions, government action, epidemic, pandemic, civil unrest, transportation disruption, supply shortages, or other similar events.

If a force majeure event occurs, we may suspend or modify services without liability for the duration of the event and for a reasonable recovery period thereafter.

10. Changes to Terms

We may revise these Terms from time to time in our discretion. Updated Terms will be posted or otherwise communicated with a revised effective date.

Your continued use of the services after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the services.
